The U.S. Department of State has released the May 2026 Visa Bulletin, and it brings a critical, time-sensitive change for Indian nationals waiting in the employment-based second preference (EB-2) category, including those with National Interest Waivers (NIW).

United States Citizenship and Immigration Services (USCIS) has announced that for May 2026, it will switch from using the Dates for Filing chart to the Final Action Dates chart for employment-based categories. This shift means that thousands of Indian applicants who are currently eligible to file their Form I-485 (Adjustment of Status) in April will lose that eligibility when May begins.

If you are an Indian national with an approved or pending EB-2 NIW petition, understanding this change and acting quickly is paramount.


The Shift to Final Action Dates: What It Means

Each month, USCIS determines which of the two Visa Bulletin charts applicants must use to file for adjustment of status. The Dates for Filing chart typically allows applicants to file their I-485 applications earlier, securing benefits like Employment Authorization Documents (EAD) and Advance Parole (AP) travel documents while they wait for a visa number to become available. The Final Action Dates chart indicates when an actual green card can be approved and issued.

For May 2026, USCIS is reverting to the Final Action Dates chart. This is a common occurrence later in the fiscal year as visa numbers are depleted, but it creates a sudden closing window for many applicants.

EB-2 India: April vs. May 2026

The impact on the EB-2 India category is substantial:

  • April 2026 (Using Dates for Filing): You can file your I-485 if your priority date is on or before January 15, 2015.
  • May 2026 (Using Final Action Dates): You can only file your I-485 if your priority date is on or before July 15, 2014.

The Critical Window: If your priority date falls between July 16, 2014, and January 15, 2015, you are currently eligible to file your adjustment of status application in April. However, starting May 1, 2026, you will no longer be eligible to file. April is your only window for the foreseeable future.


Why is the EB-2 India Backlog So Severe?

The long wait times for Indian nationals in the EB-2 category stem from the per-country limits established by U.S. immigration law. No single country can receive more than 7% of the total available employment-based immigrant visas in a given fiscal year, regardless of the country's population or the number of highly qualified applicants it produces.

Because the demand for EB-2 visas from Indian professionals—particularly in STEM fields, IT, and medicine—far exceeds this 7% cap, a massive backlog has accumulated over the years. The Visa Bulletin priority dates are the mechanism used to manage this queue.


Action Steps for EB-2 NIW India Applicants

If you are an Indian national pursuing an EB-2 NIW, here is what you need to do immediately:

1. Check Your Priority Date

Your priority date is the date USCIS received your Form I-140 petition. You can find this date on your I-140 receipt notice (Form I-797).

2. Determine Your Eligibility Window

Compare your priority date to the dates listed above.

  • If your priority date is on or before July 15, 2014, you can file in April and will remain eligible to file in May.
  • If your priority date is between July 16, 2014, and January 15, 2015, you MUST file your I-485 application before the end of April 2026.
  • If your priority date is after January 15, 2015, you are not yet eligible to file.

3. Prepare for Concurrent Filing (If Eligible)

If you fall into the critical window (July 16, 2014 - Jan 15, 2015) and have not yet filed your I-140, or if you have an approved I-140 but haven't filed the I-485, you must act immediately. Filing the I-485 allows you to concurrently apply for an EAD (Form I-765) and Advance Parole (Form I-131), granting you work and travel flexibility while you wait for the final green card approval.

4. Gather Documentation Rapidly

Filing an adjustment of status application requires extensive documentation, including medical examinations (Form I-693), birth certificates, marriage certificates, and proof of maintaining lawful status in the U.S. Gathering these documents takes time, so do not delay.


What If You Miss the April Window?

If your priority date falls in the affected range and you fail to file your I-485 before May 1, 2026, you will have to wait until the Visa Bulletin advances again to cover your priority date. Given the historical movement of the EB-2 India category, this could mean waiting several months or even years before another filing window opens. During this time, you will not be able to obtain the interim benefits of an EAD or Advance Parole based on a pending I-485.
